More Briefs Surface Showing Sotomayor's Abortion Ties...

A Washington Times editorial on Wednesday unveiled further evidence of Supreme Court nominee Sonia Sotomayor's support for unlimited abortion rights. The paper revealed the contents of four more amicus curiae briefs authored under Sotomayor, urging the Supreme Court not to "overturn or in any way restrict" Roe v. Wade.

The first such brief from the Puerto Rican Legal Defense and Education Fund (PRLDEF), where Sotomayor served as a board member between 1980 and 1992, was unearthed in late May and addressed the 1989 Supreme Court case Webster v. Reproductive Health Cases.

The brief, signed by several interest groups, stated: "All Amici share an urgent concern that the Court clearly and unequivocally reaffirm Roe v. Wade. ... They fear that any tampering with the right to abortion recognized in Roe will have a powerful, adverse impact on the liberty, equality and health of poor women and women of color."

The brief also affirmed that Roe v. Wade recognized a "fundamental right" to abortion without which women "were stripped of the right of self-determination that is a given for men."

The Times reports that similar briefs were issued under Sotomayor to the Supreme Court cases Williams v. Zbaraz, Rust v. Sullivan, Ohio v. Akron Center, and Planned Parenthood v. Casey.

While board members are not necessarily directly involved in such briefs, a May 28 New York Times article said the PRLDEF board "monitored all litigation undertaken by the fund's lawyers," and described Sotomayor as "an involved and ardent supporter of their various legal efforts."

“She just believed in the mission,” former board chairman Luis Alvarez said of Sotomayor.

Several former members testified to the Times that "Ms. Sotomayor stood out, frequently meeting with the legal staff to review the status of cases" throughout her twelve years, serving at times as board member, vice president, and chairman of the litigation committee.

Following a recent meeting with Sotomayor, pro-life Senator Jim DeMint expressed concern that the judge said she had "never thought about" the rights of the unborn child. DeMint's account corresponds to the impression of pro-abortion senators, who say their meetings with Sotomayor satisfied them that she would "respect precedent" set by Roe v. Wade.

Senator: Sotomayor Says She "Never Thought About" Rights of Unborn...

Republican Senator Jim DeMint says that he is troubled by Supreme Court nominee Sonia Sotomayor after she told him she had "never thought about" the rights of the unborn child.

"When I asked if an unborn child has any rights whatsoever, I was surprised that she said she had never thought about it," said DeMint in a statement. "This is not just a question about abortion, but about the respect due to human life at all stages, and I hope this is cleared up in her hearings."

The South Carolina senator also expressed concern that Sotomayor "was unwilling to say the Second Amendment protects a fundamental right that applies to all Americans," which he says "raises serious questions about her view of the Bill of Rights."

“Those who serve on the highest court in America must have an unwavering commitment to the Constitution and equal justice for all Americans," DeMint concluded. "I will continue to review Judge Sotomayor’s decisions and public statements and will watch her hearings closely.”

Although lacking in abortion-related opinions in her 17 years as a judge, senators probing Sotomayor's thoughts in recent weeks have said that the liberal judge is solidly in favor of upholding Roe v. Wade.

Pro-abortion senators Dianne Feinstein (D-Calif.), Ron Wyden (D-Ore.), and Olympia Snowe (R-Maine) say that Sotomayor assured them she would not tamper with the precedent set by Roe.

Also, a recently-unearthed amicus curiae brief signed by an interest group where Sotomayor served on the board of directors urged the Supreme Court in 1989 to uphold the "fundamental right" to abortion.

Capitol Hill Republicans, who have expressed a desire to slow the confirmation process to examine Sotomayor's record more closely, expressed anger after Senate Judiciary Committee chairman Patrick Leahy announced confirmation hearings would start July 13.

Three Senators Now Say Sotomayor Will Uphold Roe v. Wade...

As Sonia Sotomayor finishes making the rounds on Capitol Hill, meeting individually with lawmakers, two more US senators insist the Supreme Court nominee will continue to uphold legal abortion by maintaining Roe v. Wade as the law of the land.

Democratic Senator Ron Wyden from Oregon has become the third US Senator to affirm that Sotomayor will respect abortion law set by the legal precedent of Roe v. Wade, the 1973 Supreme Court decision that, along with its companion case Doe v. Bolton, legalized abortion on demand in all fifty US states.

“She acknowledged that Roe v Wade was precedent and established law,” said Wyden according to a report by the Oregonian.

Wyden reiterated the point and added, “Let me be clear. What I was looking for, particularly on that point, was to hear a nominee who was not going to trifle with precedent and the rule or law. She made that very clear.”

According to Politico, US Senator Olympia Snowe (R-Maine) has also stated her belief that Sotomayor would stand by Roe, although Snowe did not indicate that she would support Sotomayor’s nomination. Snowe had a 45 minute interview with Sotomayor and stated that “the essence of her approach is deference to the rule of law” and that Sotomayor had expressed her opinion that Roe v. Wade is settled law.

Senator Diane Feinstein (D-Calif.), one of the foremost advocates of abortion in the US Senate, had also met privately with Sotomayor and was first to express her conviction that she would adhere to the precedent of Roe.

The idea that Sotomayor would uphold Roe comes hardly as a surprise, as President BO would not likely jeopardize the current 5 – 4 pro-Roe majority in the Supreme Court with a nominee unknown on abortion (see coverage).

However the lack of written decisions reflecting Sotomayor’s legal reasoning on abortion has generated some discomfort among BO’s pro-abortion constituencies who are looking for reassurance that Sotomayor will not turn out to be like David Souter, the associate justice she replaces. Souter had been advertized as an anti-Roe judge and pro-life during his confirmation process under George H. W. Bush, but voted to uphold Roe in the 1992 Planned Parenthood v. Casey decision, instead of striking that precedent down as was expected, and thus return the matter of abortion to the individual states.
