The Chief Rabbi of Rome is Also Against "Gay" Marriage...

The immense crowd that invaded the streets of Paris on Sunday, January 13, to demonstrate against the legalization of “gay” marriage planned by the Hollande presidency, was astonishing for the variety of its composition.
There were Christians and atheists, Muslims and Jews, conservatives and progressives. There were also homosexuals. All of them united in defense of the natural family made up of father, mother, and children.
But the most impressive element, even before the demonstration, was the commonality of vision between Pope Benedict XVI and the chief rabbi of France, Gilles Bernheim, in expostulating the reasons for the protest:
"Carefully documented and deeply touching”: this is how pope Joseph Ratzinger described the document written by chief rabbi Bernheim against the legal recognition of homosexual marriage.
But it is not only the spiritual leader of the Jews of France who has manifested this opposition.
In Rome as well, the leader of what is considered the most ancient Jewish community of the West thinks of it in the same way.
This has been highlighted by the portal of the Italian Jews, Moked, entering into controversy with an article published by the main Italian newspaper, “Corriere Della Sera,” which implied – Moked writes – “that the document of the French rabbinate constitutes a rare and courageous exception in the context of a Judaism that is usually silent, above all in Italy, on the great civil questions.”
In reality, Moked is careful to clarify, “Italian Judaism, and with it its rabbinate, has been silent only for those who have not wanted to listen to it.”
To prove this statement, the portal of the Italian Jews recalls to memory the fact that “the chief rabbi of Rome, Riccardo Di Segni, used more than five years ago solid arguments and very clear words, for some too clear, to say the same things that Rav Bernheim is repeating today.”
The reference is to a commentary that Di Segni wrote in 2007 when the Italian parliament was discussing draft legislation backed by the government of Romano Prodi, which ultimately failed to get off the ground, granting legal recognition to de facto couples, including homosexual ones.
From this statement in 2007, which has become relevant once again today, it could be gathered in fact that on opposition to marriage between homosexuals, the voice of the rabbi of Rome is in tune with the chief rabbi of France and with the pope, albeit with differences – reiterated by the portal Moked – on other questions with serious moral implications, like assisted fertilization.
Di Segni writes in the central passage of his commentary:
"According to the Torah, Jews must observe 613 rules, but this does not mean that non-Jews must not have any rules, because in reality they too have them, arranged under seven fundamental headings, called Noahtic precepts, natural law."
They are words that document how the existence of a “natural law” valid for all the descendents of Noah, meaning for all men, is not a fixation of the pope, of the bishops, and of the Catholic Church. But, according to the authoritative view of the chief rabbi of Rome, it is a fundamental thesis for Judaism as well.
And this also has consequences in public life. Di Segni writes: "It is our duty as Jews to induce non-Jews to respect their rules . . . We cannot remain indifferent to the exceeding of certain limits, agreeing for example that the law of the state should admit homicide, theft, incest," and now also "homosexual couples." When society "greatly exceeds illicit limits it is our duty to oppose these choices."

ON THE RECOGNITION OF HOMOSEXUAL COUPLES

There is a strange silence of the various representatives of Italian Judaism on an issue that has been highly debated in Italy, that of the law on the “rights and duties of persons cohabiting stably,” abbreviated DICO, the law on de facto unions [which was presented in 2007 by the Prodi government].
Some people, perhaps not very well informed, have maintained that a presumed silence of ours would be due to the reluctance not to share publicly the positions of the Catholic Church.
It is true and also strange that Jewish institutions have not yet taken part in a debate that involves more generally the issues of state policies concerning the family. But there are two good reasons why this silence should be broken.
The first of the two good reasons is external, in the sense that it involves the responsibility of Judaism toward external society.
The other is internal, concerning the structure and future of our community.

Let's look at the first. One of the most delicate and controversial issues in the draft legislation on the DICO is the legal recognition of cohabitation also between persons of the same sex.
It is certainly not the homosexual marriage accepted formally in other countries, but in any case it is a first form of legal recognition of homosexual unions. In the debate on this issue there enter into play elements of principle of the foundations of modern society, the question of state secularism, individual liberties, the interference of religious principles, etc.
What does the Jewish tradition have to say in this regard? One political position customary among Jews, and often shared also among the more observant, is that of not interfering in the choices of freedom that the state makes for its citizens, reserving only to the individual conscience the right and duty of making rigorous personals choices on arguments in which the law of the state makes room for autonomy and freedom.
But this rule cannot always be applied. According to the Torah, Jews must observe 613 rules, but this does not mean that non-Jews must not have any rules, because in reality they too have them, arranged under seven fundamental headings, called the [precepts of Noah or] Noahtic precepts, natural law. And it is our duty as Jews to induce non-Jews to respect their rules.
It is difficult to say how this can be realized. What is certain is that we cannot remain indifferent to the exceeding of certain limits, agreeing for example that the law of the state should admit homicide, theft, incest.
The argument that is being debated now falls, in terms of some of its aspects (not cohabitation in general so much as male homosexual couples specifically), within limits that are held to be inviolable.
The problem does not even seem very new, as demonstrated by a passage of the Babylonian Talmud (Chulin 92b) in which it is said that among the few limits that the nations of the world have not exceeded is that they have not yet consented to “writing the Ketubbà for males," even if they are certainly not attentive to respecting the ban on homosexual practices. The Ketubbà is the marriage contract in which the groom pledges himself to the bride. “Writing the Ketubbà for males” means sanctioning homosexual union with a regime of legal and economic guarantees.
In short, even if this attitude could be considered hardly “politically correct” according to the current sensibility, we must not ignore the fact that according to our tradition the society that is about to make these decisions is greatly exceeding illicit limits and it is our duty to oppose these choices, not to remain indifferent.
Obviously, our only tools are those of democracy: speech, the vote. But we cannot do without using them. The fundamental objection is that in this way we are going against free rights to individual choices. But on “boundary” issues like these, which are not at all shared by large majorities, there is also the right and the duty to dissent. There never exist unlimited rights, and all are called to decide the definition of the limit.

The second reason why the debate in progress must not leave us indifferent concerns general issues of the family.
The law on de facto unions is the expression of a radical change in the structures of contemporary society, in which the traditional institution of the family no longer represents the absolutely prevalent model of organization.
Society is changing, and the law must take this into account. Therefore it would not make sense to rail against a law that seeks to give some protection and security, as well as to guarantee forms of solidarity toward the weak who in our tradition are of essential importance.
Therefore, apart from the main reservation expressed above, if the problem is the defense of the weak we must be in favor. But it must be seen if this is truly the problem, and if the law proposed is capable of resolving it.
The problem for us is another, because the general debate in progress has distorted the perspectives, reducing the question to opposition between the defenders of civil liberties and the defenders, like the Catholic Church, of the traditional model of the family.
It is an engaging debate, but if we stop at these two polarities we run the risk of ignoring what must be the true problem for us, which lies at the origin of the law and which involves us as Italian Jews in a devastating way, even if it seems that we have not yet realized it.
Jewish Italian society, as in the rest of the Western world, has made its own the models of organization of non-Jewish society, and very often has even anticipated them. But the price that it has paid and is paying because of this collective choice is the evolution toward drastic numerical contractual, in some places nearing extinction.
In some communities there has been a reduction all the way down to 45 percent. Only Rome seems to be sheltered a bit from the demographic “hurricane,” but the results expected in the medium term are not encouraging. The causes of the disaster are multiple: we marry less and much later, there are many fewer children, marital bonds are very unstable (separations, divorces), the general population is aging and the number of deaths every year exceeds that of births. To this is added the problem of mixed marriages which, when they are entered, are very often nothing more than cohabitation.
Without considering the religious issues, it is undeniable from the social point of view that these mixed unions are the sign of a weak relationship with Judaism, and that from two partners, one non-Jewish and the other weakly connected to Judaism, in the great majority of cases the descendents will be even more weakly connected to Judaism and it will be of very little use, in Jewish terms, to have one parent request formal conversion.
This is what the modification or crisis of the traditional model of the family means for us. Perhaps the surrounding society can allow itself (up to a certain point) to remodel itself according to the modified economic and social conditions. We cannot. And so it must be clear that if we make the debate over the DICO into a nice question of civil rights we have not yet understood anything about our true problems. It is urgent that everyone take stock, and the leadership in particular, and begin a serious policy on the issue of the family.
