Tennessee Senate passes uncompromising Pro-Life Amendment...

The Tennessee Senate has passed a constitutional amendment that could, if also passed by the state's House of Representatives, nullify a state Supreme Court ruling that claims that abortion is protected under the Tennessee constitution.

The amendment reads: "Nothing in this Constitution secures or protects a right to abortion or requires the funding of an abortion. The people retain the right through their elected state representatives and state senators to enact, amend, or repeal statutes regarding abortion, including circumstances of pregnancy resulting from rape or incest or when necessary to save the life of the mother."

The measure passed with support from both Republicans and Democrats, 23-9. Attempts to add rape and incest exceptions were defeated.

The measure has passed the Senate three times since the Tennessee Supreme Court issued a decision in the year 2000, claiming that the state constitution is more protective of abortion than the US Constitution. That ruling got rid of the state's 48-hour waiting period for obtaining an abortion, and a requirement that abortion facilities provide information about the procedure to their customers.

In each of the three previous cases, the state House of Representatives has failed to endorse the constitutional amendment. That hasn't stopped lawmakers from passing it a fourth time, however, in the hope that they might nullify the state judiciary's pro-abortion stance. Like Roe v. Wade, the Tennessee ruling was based on a subjective interpretation of the state constitution, which never mentions abortion.

State Senator Diane Black, who sponsored the amendment, told the Associated Press that she is optimistic about its chances of ratification this year, given the broad support shown for the measure in the Senate. "I'm hoping that this year will be the year given the kind of bipartisan support we had today, and I think we will have that same support over in the House," said Black.

The amendment, should it be approved by the House, will have a long way to go before complete ratification. It would then have to be approved by the Senate and House by a two-thirds majority and be ratified by a plebiscite of all Tennessee voters, which could happen by 2010.

Republican presidential candidate Mike Huckabee lead a crowd of more than 5,000 Georgia residents at a pro-life rally on Tuesday. Huckabee spoke of his pro-life views and the rally served as an event to help spark the promotion of a constitutional amendment that would restore personhood to unborn children.

“We're in the middle of 35 years of a national nightmare that needs to end soon,” Huckabee said at the rally. “I've always said I got into politics because I'm pro-life.”

He repeated his message that a national human life amendment is needed and that overturning Roe and letting states ban abortions is merely a first step in protecting human life.

"There cannot be a geographical distinction when it comes down to something that is either right or wrong," he said. "The logic that each of the states can come up with their own definition of how to respect human life is the logic of the Civil War. And we saw how that turned out."

"This is not a political issue, it is a moral issue," he said.

Georgia Right to Life executive director Nancy Stith said Huckabee's presence surely helped the group set an attendance record but she said the amendment is drawing in new supporters as well.

“Part of it’s the excitement of HR 536,” she told the Times Free Press newspaper. “It’s excitement in grass-roots involvement.”

HR 536 is the “Paramount Right to Life” amendment that would extend constitutional protection to unborn children “from the moment of fertilization without regard to age, race, sex, health, function, or condition of dependency.”

Huckabee's support for the amendment played a role in his receiving the pro-life group's endorsement. He applauded the amendment on Tuesday and talked about his own efforts for similar legislation in Arkansas.

State Rep. Martin Scott, a Republican from Rossville who is sponsoring the measure in the legislature, is telling lawmakers that it could help boost turnout among the GOP base in the 2008 general elections if they can get it on the ballot.

Scott says that passing House Resolution 536 would make Georgia the first completely pro-life state that outlaws every objectionable practice that targets unborn children or the disabled.

The Thomas More Law Center, a pro-life law firm based in Michigan, drew up the legislation for the group and it focuses on establishing a full-fledged right to life for unborn children.

The state legislature has approved other pro-life laws that have lowered abortions. Though Georgia's population has increased 42 percent, the number of abortions has dropped 18 percent.
